Los “Principios de Ecuador” y algunas apreciaciones sobre la implementación del concepto de “desarrollo sostenible” en la actividad minera en el Perú
Abstract
El propósito de este artículo es evaluar la eficacia de las políticas de Desarrollo Sostenible en minería que viene dictando el Estado Peruano y en qué medida estas podrían contribuir a minimizar los riesgos de conflictos sociales asociados con esta actividad. Para ello, analiza la adecuación de la normativa peruana a los “Principios de Ecuador”, instrumentos de Derecho Internacional no vinculantes que contemplan mejores prácticas para la protección del ambiente natural y social como una condición para el financiamiento de proyectos. En el desarrollo de su investigación, el autor aborda temas interesantes como el rol de las instituciones financieras y “project finance” en minería, y comenta normativa en el Perú relacionada con el desarrollo sostenible de la actividad minera (Ley de Consulta Previa y normas para combatir la minería ilegal).
