Categoría jurídica de los animales de compañía en el Derecho Civil peruano

Abstract

En la actualidad, existe un vacío en la normativa peruana sobre la protección jurídica de los animales de compañía en el Derecho Civil; si bien se publicó la Ley de Protección y Bienestar Animal, su contenido no abarca situaciones en el Derecho Civil. Por ello, con el presente trabajo de investigación se pretende categorizar al animal de compañía en el Derecho Civil y ver en qué áreas de este se pueden tratar y ubicar al animal doméstico de compañía. Para lograr el objetivo se acudió a artículos científicos, literatura especializada, conferencias y cursos de la materia. Adicionalmente, se realizará entrevistas a reconocidos profesionales y especialistas en la materia que aportarán con su experiencia y conocimientos a este trabajo de investigación.

Currently, there is legal loopholes in the Peruvian legal system about legal protection of pets in Civil Law. Although Animal Protection and Welfare Law was enacted, it´s content does not cover Civil Law situations. Therefore, with this research project, the aim is to categorize pets in Civil Law and look in which areas it’s possible to classify them. The support of study and analysis of scientific articles, specialized literature, conferences and courses in relation of the subject will be enlisted. Furthermore, interviews to esteemed professionals will be conducted in the subject, they are going to contribute with their experience and knowledge to this research project.
