Tarifas por el uso de aguas subterráneas en Lima y Callao (2015-2017): análisis desde el derecho empresarial y la evolución jurídica del cobro en la gestión de Sedapal

Abstract

Esta tesis analiza el marco legal y financiero que rodea el uso de las aguas subterráneas en Lima y Callao entre los años 2007 y 2017, con especial atención a las tarifas impuestas por su uso. El estudio explora la naturaleza jurídica de los pagos realizados por los usuarios, distinguiendo si constituyen impuestos, compensaciones económicas o precios públicos. La investigación revisa el marco regulatorio peruano —incluyendo la Constitución, la Ley General del Ambiente y la Ley de Recursos Hídricos— y analiza la jurisprudencia del Tribunal Constitucional, el Tribunal Fiscal y la Corte Suprema. Se presta especial atención a la aplicación del Decreto Legislativo N.º 1185 en su segunda disposición complementaria transitoria, que introdujo un nuevo esquema de pagos para el monitoreo y la gestión del uso de las aguas subterráneas. Los hallazgos resaltan inconsistencias en la clasificación y la aplicación de dichos pagos, lo que revela la necesidad de interpretaciones doctrinales y legales más claras para garantizar la gestión sostenible del agua y la seguridad jurídica.

This thesis analyzes the legal and financial framework surrounding groundwater use in Lima and Callao between 2007 and 2017, with particular attention to the fees imposed for its use. The study explores the legal nature of user payments, distinguishing whether they constitute taxes, economic compensation, or public prices. The research reviews the Peruvian regulatory framework—including the Constitution, the General Environmental Law, and the Water Resources Law—and analyzes the jurisprudence of the Constitutional Court, the Tax Court, and the Supreme Court. Particular attention is paid to the application of Legislative Decree No. 1185 in its second complementary transitory provision, which introduced a new payment scheme for monitoring and managing groundwater use. The findings highlight inconsistencies in the classification and application of such payments, revealing the need for clearer doctrinal and legal interpretations to ensure sustainable water management and legal certainty.
