La necesidad de regular como herederos forzosos a lospadres e hijos afines de una familia ensamblada.

Abstract

El presente trabajo centra sus objetivos en realizar un análisis critico sobre el derecho a heredar y su regulación jurídica principalmente a los miembros que conforman las familias ensambladas, que según el pronunciamiento del Tribunal Constitucional, reconoce que existe un nuevo tipo de familia donde adquiere deberes y derechos como parentesco por afinidad, impedimentos matrimoniales y asistencia mínima para los integrantes de esta familia; sin embargo no exhorta al Congreso de la República para que realice modificaciones al código civil como establecer leyes especiales con la finalidad de regular los deberes y derechos; y, en adición a ello, es menester recalcar la necesidad de regular como herederos forzosos a los padres e hijos afines, ya que, al ser un nuevo tipo de familia, se extiende también al derecho sucesorio.

The present work focuses its objectives on carrying out a critical analysis of the right to inherit and its legalregulation mainly to the members that make up the blended families, which according to the pronouncement ofthe Constitutional Court, recognizes that there is a new type of family where it acquires duties and rights suchas kinship by affinity, marriage impediments and minimum assistance for the members of this family; however, itdoes not urge the Congress of the Republic to make modifications to the civil code, such as establishing speciallaws with the purpose of regulating duties and rights; and, in addition to this, it is necessary to emphasize theneed to regulate parents and related children as forced heirs, since, being a new type of family, it also extends toinheritance law.
